The statute nobody can hand you

Most states answer a dog attack with a liability statute. This one does not. The single provision written specifically about dogs, NRS 202.500, sits inside the criminal chapter on offenses against public health and safety, and it says nothing about paying for a wound. The money question runs through NRS 41.130, which makes a person who causes personal injury by wrongful act, neglect or default liable to the person injured. Chapter 41 has a section about damages for harming someone's pet. It has none about a dog harming a person.

What the high court used instead of a statute

In a 1989 appeal over a boy mauled while walking home from swimming, the state's high court measured the defendant against basic tort principles rather than any animal statute. It quoted an earlier decision refusing to except landlords or property owners from the general application of the basic principles of tort law, and said the defendant, like anyone else, had to use reasonable care not to subject others to unreasonable risk. The full opinion is worth reading because it shows what a court here actually looks at: knowledge, promises, control of a gate, and what a reasonable person would have done with all three.

Dangerous, vicious, and the count of two

The criminal section is still your best friend, because it defines the vocabulary. A dog is dangerous if, unprovoked and on two separate occasions within eighteen months, it behaved menacingly enough that a reasonable person would defend against substantial bodily harm, while off its owner's premises or not confined in a cage, pen or vehicle. It is vicious if it killed or inflicted substantial bodily harm on a person without provocation, or if it kept behaving that way after law enforcement told the owner it was dangerous. Provoked has a narrow meaning: tormented, or subjected to pain. Breed cannot supply the label, and no local government may write an ordinance that does.

Why a criminal label matters to a civil file

Knowingly keeping a vicious dog more than seven days after actual notice is a misdemeanor, and so is passing it to someone else. When substantial bodily harm results from an attack by a dog known to be vicious, the keeper faces a category D felony. NRS 193.130 sets that at one to four years in prison plus a fine of up to five thousand dollars, and the judge may order the animal destroyed. For a civil claim the value is documentary. A notice from law enforcement calling a dog dangerous is written proof of exactly the knowledge an owner will later deny having.

The leash rule that can do a statute's work

Clark County defines an animal at large as one not held by a leash or lead no longer than six feet under adequate control, or not confined inside the owner's property line. The same definition reaches voice-command-only control and unrestrained dogs in the common areas of a common interest community. Inside city limits the parallel rule is Las Vegas Municipal Code 7.36.030. This matters because of a 2001 decision holding that violating a code provision adopted by county ordinance is negligence per se when the injured person is in the class the provision protects and the harm is the type it aimed to prevent. Those two questions belong to the judge; violation and causation go to the jury.

Deadlines and the fault line

Two years is the period for an injury caused by another's wrongful act or neglect. Comparative fault then sets a hard edge. Recovery survives only where the injured person's share of negligence was not greater than the combined share of those being sued, and the jury is told plainly that a larger share means nothing at all. That is why an early apology, a reached-over fence, or a hand offered to a strange dog gets so much attention from the other side.

Where the wound and the case both end up

Severe attacks in the valley route to the county's public teaching hospital, which describes itself as the state's first and only nonprofit Level I trauma center and reports a catchment of ten thousand square miles reaching into California, Utah and Arizona. Those records carry weight. On the legal side, justice court can hear a personal injury action only where the damages claimed stay at or below fifteen thousand dollars, so anything with real scarring or surgery belongs in district court at the Regional Justice Center downtown.
